Pointing out that it appreciated the situation confronting the security forces in Kashmir, Chief Justice Jagdish Singh Khehar, Justice D.Y. Chandrachud and Justice Sanjay Kishan Kaul said the alternatives to pellet guns should be "very very technology-based measures" that protect both sides.

Terming the issue as a very important one, the bench had asked both governments should sit together and take a stand on it.

March 27 (ANI): The Supreme Court on Monday issued a notice to the Centre and the Jammu and Kashmir Government asking them to file a reply on the issue of getting benefits by the minority community in the state within four weeks.

Additional Solicitor General (ASG) Tushar Mehta told the Court that the issue was being considered by the Centre at a pan-India level.

Appearing for the state government, senior lawyer Gopal Subramanium said he had advised the Jammu and Kashmir government to demonstrate utmost "inclusiveness" and grant equal protection to all communities.

The apex court was hearing the plea filed by Kashmir High Court Bar Association (KHBA) seeking direction in the use of pellet guns.

Sharma also sought that at present, the wrong people are getting illegal benefits of welfare schemes meant for the minority community.

The PIL insisted on constitution of a State Minorities Commission as the provisions of the National Commission for Minorities Act did not apply to Jammu and Kashmir due to Article 370 of the Constitution. This unavailability of the minority status and absence of due share in benefits are jeopardising their constitutionally guaranteed rights that is enshrined under Part III of the Constitution of India.

"We hope and expect that a fruitful decision will emerge on the next date of hearing", the Bench added.

"Appoint a committee of experts functioning under the direct supervision of this court to submit a comprehensive report identifying communities of the state of Jammu and Kashmir which qualify as religious and linguistic minorities", the PIL said.
