Democrats threaten delay on Neil Gorsuch

White House press secretary Sean Spicer called on Schumer to call off the filibuster, saying "it represents the type of partisanship that Americans have grown exhausted of". The support of eight Democrats would short-circuit a filibuster. If the Democrats do indeed filibuster, the Senate could change the rules and lower the threshold to 51 votes (they have 52 now).

In response to the Democratic criticism, Gorsuch repeatedly said he has often ruled for the "little guy" over corporations. Such a change also would apply to future Supreme Court nominees and would be especially important in the event that Trump gets to fill another opening and replace a liberal justice or Justice Anthony Kennedy, the court's so-called swing vote. It would take 60 votes to end a filibuster and force a vote.

Grassley said that he wished Schumer could have seen the way Gorsuch was acting in his Supreme Court nomination hearing. Yet, he was among the Republicans who refused to accord Garland a hearing - not because he wasn't eminently qualified, but only because he was President Barack Obama's pick.

On Thursday, lawyers, advocacy groups and former colleagues got their say on Gorsuch during the final session to examine his qualifications.

Schumer said if Gorsuch can not attract 60 votes, "the answer isn't to change the rules".

Gorsuch received the American Bar Association's highest rating after what ABA official Nancy Scott Degan called a "deep and broad" investigation.

The senator outlined his opposition to Gorsuch after meeting with him. "But Judge Gorsuch didn't convince me that he would be an independent voice on the court". Garland is also supported by notable jurists of all stripes.
