The deceased man has been identified as Nathaniel Joseph Rosa, 31, of Bothell.

Fanning, who appeared at a bail hearing on Monday, told police that he found Rosa in the shower of his second home, which he uses for his online business selling knives, blowguns and paintball guns. He entered his business on Saturday morning to find that a break-in had occurred and that the intruder was in the bathroom taking a shower, the sheriff's office said.

Prosecutors now have until Wednesday to decide whether to charge him with first-degree murder, stick with his current second-degree count or charge him with something else.

Fanning was arrested Saturday after calling 911 to report that he had shot and killed an intruder inside his business at 1520 E. Trails Road in Belfair.

"He returned home, retrieved a firearm, came back over to the residence and fired multiple rounds into the shower ... killing the intruder", Mason County Sheriff's Lt. Travis Adams told ABC affiliate KOMO.

The sheriff announced the arrest via Twitter and said it would release more information in a press release Monday. Fanning said that the victim was intoxicated and threatened him.
