Supreme Court blocks appeals court ruling that limits Trump's travel ban

At the request of the Justice Department, the Supreme Court stayed a lower court ruling that would have exempted some people for the administration's ban on refugees.

The US Supreme Court kept the Trump administration's strict refugee ban in place Monday, at least temporarily dashing the hopes of some 24,000 already-approved immigrants.

The top justices of the country will sit for a hearing to discuss if the ban was legal or not.

The 9th Circuit upheld a decision by U.S. District Judge Derrick Watson on refugees with resettlement assurances that had been stayed by the U.S. Supreme Court pending the appeal.

The 9th Circuit's ruling applies to the executive order, issued by President Donald Trump in the early days of his administration, which blocks travelers from Iran, Libya, Somalia, Sudan, Syria and Yemen from entering the USA for 90 days following its implementation. The ruling would have allowed refugees to enter the country if they obtained promises of assistance from refugee resettlement organisations.

Resettlement agencies argued that their commitment to provide services for specific refugees should count as a "bona fide" relationship.

"This Court's ruling can not plausibly bear that construction, which would as a practical matter render the partial stay this Court granted as to the refugee provisions a dead letter", the administration said. A series of court decisions since then have said that order must include people with grandparents and cousins in this country.

The Trump administration said it should not, meaning such refugees would be barred.

Time is beginning to become of a factor in the broader fight over Trump's travel ban, with the Supreme Court scheduled to hear arguments October 10.

The latest, in this unnecessarily long and drawn out saga, is the 9th Circuit's opinion allowing just about every family member of foreign nationals receiving visitor benefits exemption from the president's travel order which took aim at countries known to be state sponsors of terror (Iran, Libya, Somalia, Sudan, Syria, and Yemen).

If the measure is considered to have taken effect from when the Supreme Court allowed a partial version of it, the 90 days will have passed by the time the justices hear arguments, and the 120 days are very likely to have passed by the time they issue a decision.
