Zachary Cruz, 18, was arrested at Marjory Stoneman Douglas High School and charged with trespassing on school grounds, a Broward Sheriff's Office report said.

The AP obtained documents in the criminal case against Nikolas Cruz that reveal school officials and a sheriff's deputy thought Cruz should be involuntary committed for a mental evaluation back in September 2016.

If Cruz had been committed under the Baker Act, it would have made it hard for him to buy a gun legally.

Cruz was arrested after 14 people were gunned down at Marjory Stoneman Douglas High School in Parkland, Florida, on Valentine's Day.

Cruz is accused of the shooting rampage that killed 14 students and three school employees at Marjory Stoneman Douglas High School in Parkland on February 14. Zachary Cruz was being held on a $25 bond, while his brother, Nikolas Cruz is charged with 17 counts of murder and 17 counts of attempted murder, and has no bond, county records showed. Surveillance video showed that the deputy remained outside the freshman building during the shooting and did not try to confront Mr. Cruz, in apparent violation of the Broward County Sheriff's Office policy for dealing with active shooters.

Under Florida's Baker Act, involuntary commitment of a person may be initiated by an official, including a judge, mental health physician or law enforcement officer, such as Peterson. Cruz admitted he did so over his failed relationship, according to documents.

If Cruz had been institutionalized, it would have appeared on his record and constituted a major red flag at the moment of trying to buy a gun.

The brothers were adopted by Lynda and Roger Cruz when Nikolas was 2 and Zachary was two months old, friends and relatives said. Clinicians had repeatedly concluded that the Baker Act would not justify committing Mr. Cruz because he denied having an intent or a plan to hurt himself or others. He faces the death penalty if convicted.

Other red flags have also surfaced, including calls to the Federal Bureau of Investigation about Cruz's potential to become a school shooter and numerous visits by county law enforcement officials to his home - both before his mother died in November and after, when he lived briefly with a family friend in Palm Beach County.
