Gates' alleged communications with the former intelligence officer were revealed in a sentencing document for former Skadden Arps attorney Alex van der Zwaan.

It is unlikely that Manafort will escape conviction now that his co-defendant Richard Gates has agreed to work with the special counsel and the charges against him are no longer focused on rarely-prosecuted legal infractions involving the Foreign Agents Registration Act (FARA).

The filing identifies the ex-spy only as Person A. The description of him by prosecutors, a person living in Moscow and Kiev who worked with Manafort and Gates in Ukraine, matches that of Konstantin Kilimnik.

Mueller's office did not make a judgment on what van der Zwaan's sentence should be, but pointed out his experience as a longtime lawyer and the fact that he lied to them after Gates and former Trump campaign chairman Paul Manafort were indicted in the Russian Federation probe. In the sentencing memorandum filed late Tuesday, Muller said the lawyer was "expressly warned by the government that it is a crime to lie to the Special Counsel's Office, that lying could constitute a federal crime, and that such conduct would carry with it the possibility of going to jail if he were convicted. van der Zwaan stated that he understood".

Tuesday's filing from Mueller's office says the fact that "Gates and Person A were directly communicating in September and October 2016 was pertinent to the investigation".

Mueller's office accused Manafort in December of working with Kilimnik to help ghostwrite an op-ed past year about his consulting work in Ukraine.

Mr. van der Zwaan was an attorney at a firm that worked with Mr. Manafort and Mr. Gates to prepare a report used to defend Viktor F. Yanukovych, the former Ukrainian president, from global criticism over the prosecution and incarceration of one of his political rivals.

Both Mr. Manafort and Mr. Gates were indicted previous year for money laundering and other financial crimes committed while, the charges said, they tried to hide the money they received for their Ukraine work.

Gates has recently started cooperating with Mueller's team.

A Manafort spokesman expressed confidence in June that investigators would ultimately conclude that Manafort's interactions with Kilimnik were "perfectly permissible and not in furtherance of some conspiracy".
